Recently, an infertile couple U.S. visited India. Doctor asked why they came to India? Is America running out of healthy uterus, too? He said that if they can outsource everything to India. So why not outsource a uterus for pregnancy to India.
Indian government plans to make industry surrogacy (renting a uterus for pregnancy) is perfectly legal for both Indian and foreign couples wishing to surrogacy in the India. Renting a uterus (surrogacy) is a method of reproduction whereby a woman agrees to become pregnant and give birth to a contracting party. If a woman is unable to conceive naturally and/or carry a pregnancy, the embryo may be placed in the uterus of another woman for gestation.

The bill proposes strict rules for foreigners seeking surrogate mothers for the rental of the uterus during pregnancy. It will be obligatory for foreigners to present two certificates - one on the politics of their countries on surrogacy and the other indicating that the child born to a surrogate mother in the uterus of the lease will be to obtain the citizenship of their country. "They must also appoint a local guardian who will take care of the surrogate mother during the gestation period of the rented uterus for pregnancy

I know it means that better regulations are put in place, which is good. Perhaps it's the title - rent a uterus - which makes something that is really very beautiful, personal and private sound kind of sordid...in-vitro fertilization / reproductive technology by using uterus of another woman is advance medical treatment available for infertile couples .It is available in all good hospitals of west and lately in India also.
Perhapes availability of uterus of donour women is limited in west, so infertile couples have no option other then renting it whereever available and it make it business.
In india,this illegal business is carried out by some leading private in-vitro fertilization centers, encouraged forigners by hiring poor but healthy women. For foreigners availing this facility ,the citizenship of new borne become involved. It become illegal.Many foreigners couple are in litigation for their child. Until social organisation in west help their infertile couple, they have no option but have child through industry surrogacy .

With our country filled with lobbyists like Nira Radia, definitely they could make a lot of money. :-) On the other hand, yea it's a good concept, but I will only have to question the genuineness of this whole outsourcing idea. Doesn't seem to be a very smooth process.Drunken Mystic, 2 to 4% people of world are infertile. Infertility in west people is more as they drink and perserved food which carry more chemical and salts.
While a woman is unable to conceive naturally and/or carry a pregnancy, the technonlogy to place embryo in the uterus of another woman for gestation is avalable now. But in India,this techolonoly is cheapest and best available in India and is for India people. But infertile couple from west are attracted to India. This make it illegal trade. To protect the interest of surrogate mother and natinalty of child borne in other country, this law is coming up . Many people of west also visit India for adoption, and we have already law on it to avoid it as illegal business.
The more you ban anything, the more it flourish as illegal business and create black money. As India is closed economy with high tax, resulting India money is flourishing in Tax havens, as you mention Nira Radia.I am not certainly out for a ban, but when the people in the government themselves are misusing the law, what do you do to stop them? Look at Raja enjoying the benefits of breaking into the treasury. Surrogacy is a very good thing and certainly it has paved the way for many infertile mothers. You do make a good explanation here. We must be careful that adultery doesn't set into this as well. There were cases of surrogacy where, mothers were not willing to let go of their surrogate babies. One German father had to file a lawsuit to take his twin babies back with him. One must look into these issues.Drunken Mystic, you have rightly pointed out why this law of surrogacy is actment. Nice article Gaurav. I think the main reason for outsourcing this service to India is pretty much the same as for other outsourced jobs. The price. I think as is witnessed by the population explosion in both countries that fertility rate is not an issue which is of major concern, but rather the price of the pregnancy given your medical care costs and cost of living. Also what may be contributing to the upsurge in this area is the high rate of extortion after carrying the baby to term. Even with a contract the babies mother can not be compelled by the court to give up her parental rights leading to the negotiations of higher costs to get custodial rights to the child.Sir,David Levitt,I do appreciate your comments.Thanks.
Hi Gaurav.Legislating it as a business makes sense in that the surrogate mothers will undoubtedly get better treatment than they might otherwise. Though why you wouldn't want to treat the woman carrying your child well, I can't imagine. Even so, I'm sure a fair number of them get treated badly. But it just seems a bit odd making a business out of it. If there were simply an agency that put willing women (who do it for love and not money) in contact with those needing a surrogate, I'd be more comfortable with it. surrogacy for love is always good thing.It is through social organistion their respective countries. It is rarely performed for unknown strangers. Surrogacy as business for foreigner or own people is simply prostitution.I agree.
surrogacy for foreign involve the problem of citizenship of a child , The act is perhapes to solve this ploblem.
